Website use
By using this website you agree to:
- Use the site for lawful purposes only.
- Not attempt to gain unauthorised access to any part of the site or its underlying systems.
- Not scrape, copy or reproduce site content for commercial purposes without written permission.
- Accept that website content (including pricing ranges, project timelines, design recommendations) is provided as general guidance and is not a binding offer or contract until a written quote is signed.
Quotes and consultations
Initial consultations and verbal cost bands are free of charge and impose no obligation on either party. Written cost bands provided after consultation are general guidance based on the brief described. A binding agreement is created only when a fixed-price written quote is signed by both parties and a deposit (where required) has been paid.
We reserve the right to revise a quote where the underlying brief changes (for example, scope additions, material changes, structural surprises uncovered during demolition). All revisions are documented and signed before work proceeds.
Pricing and payments
Quoted prices include GST unless otherwise stated. Standard payment terms:
- Deposit on signed quote — typically 20 to 30 percent of total project value, payable on signing.
- Progress payments — milestones tied to cabinetry production, delivery, install start and completion. Schedule documented in the contract.
- Final payment — on completion and snag-list sign-off.
Payment methods: bank transfer, EFT, credit card. Late payment may attract interest at the rate specified in the contract.
Warranties
Kitchen Fox warrants:
- Cabinetry — seven years on workmanship and materials, in writing, on every cabinetry install.
- Hardware — Hettich, Blum and similar manufacturer warranties pass through directly to the customer; typically 10 to 25 years on hinges, drawer runners and soft-close mechanisms.
- Stone benchtops — fabricator warranty (typically 10 years on quartz, 15 to 20 years on porcelain and sintered stone) passes through directly to the customer.
- Electrical and plumbing work — performed under licensed sub-contract; warranty per the licensed contractor’s terms, typically 12 months on workmanship.
Statutory consumer guarantees under the Australian Consumer Law (ACL) apply in addition to and override any inconsistent term in this agreement.
Limitation of liability
Subject to the Australian Consumer Law, Kitchen Fox’s liability for any loss or damage arising from a project is limited to the contract price for that project. Kitchen Fox is not liable for indirect, consequential or special damages, including loss of profit or loss of opportunity, except where such liability cannot be excluded by law.
We carry public liability insurance and provide a certificate of currency on request.
Cancellation
You may cancel a signed contract before commencement of work, subject to:
- Forfeiture of any deposit paid (deposits are typically non-refundable as they cover design, drawings and supplier commitments).
- Reimbursement of any costs incurred to date (cabinetry components ordered, stone slabs reserved, etc.).
After cabinetry production has commenced, cancellation is subject to negotiation case-by-case. We do not unilaterally retain customer funds beyond actual costs incurred and a reasonable margin on work completed.
Dispute resolution
If a dispute arises, both parties agree to attempt resolution in the following order:
- Direct discussion between the parties to understand the issue.
- Written notice of dispute, with 14 days for the other party to respond.
- Mediation through a mutually-agreed mediator, with costs shared equally.
- Jurisdiction of the courts of South Australia.
You may also refer disputes to Consumer and Business Services South Australia (CBS) or the Office of the Small Business Commissioner SA.
Intellectual property
Designs, plans, drawings and proposals produced by Kitchen Fox remain the intellectual property of Kitchen Fox until full payment is received, after which use rights are granted to the customer for the project. Reproduction or use of Kitchen Fox designs for unrelated projects is not permitted without written consent.
Changes to these terms
We may update these terms from time to time. The “last updated” date at the top of the page reflects the most recent revision. Material changes will be notified to active customers in writing.
